1. PLACING AN ORDER

1.1 When you place an Order for a Product in any of the ways listed above you are agreeing to buy it for the price stated, subject to these Terms.

1.2 When you place an Order online we will send you and email to confirm that we have received it. This email confirmation will be produced automatically so that you have confirmation of your Order details. The fact that you receive an automatic confirmation does not necessarily mean that we will be able to meet your Order. If a Product is not available we will endeavour to let you know via email.

1.3 Janey McGill Photography reserves the right to cancel any sale and not supply Products if it is reasonable to do so and may change or discontinue the availability of Products at any time at its sole discretion. If an order is cancelled, any payment made for the Products will be refunded in full. This does not affect your Statutory Rights.

1.4 All new Orders are deemed separate and each is treated individually.

1.5 We endeavour to ensure that all prices on Janey McGill Photography are accurate but errors may occur. If we discover an error in pricing of the Products in your order we will inform you as soon as possible using the contact details you have supplied us with. We will then give you the option of re-confirming your Order at the correct price or cancelling it. (If we are unable to reach you we will treat the Order as cancelled). If an Order is cancelled, any payment made for the Products will be refunded in full.

1.6 Prices are quoted on Janey McGill Photography in UK Pounds Sterling – outside the UK your credit card company will charge you in your local currency at the current rate. Please note that both charges and refunds are in UK Pounds Sterling and Janey McGill Photography cannot be held responsible for any loss due to exchange rate fluctuations.

1.7 Non-UK customers are responsible for Import Duty/Tax in their respective countries. Unfortunately we cannot advise you what these costs will be – please consult your local customs office for more information.

2. PAYMENTS

2.1 You must pay for your Order before it is delivered and you can do so by credit card, debit card, or BACS.

2.2 If your delivery address is outside the UK and you order online you must pay by credit card.

3. CREDIT CARDS

3.1 Orders may be processed online or via email using a credit or debit card (Visa, MasterCard, American Express, Delta and Switch/Solo).

3.2 To ensure that shopping online is secure, we do not store our customers financial details. All credit/debit card are encrypted and processed via Stripe to ensure that these details cannot be intercepted by a third party.

3.3 Your credit card company may also carry out security checks to confirm that your order is genuine.

3.4 All Orders are subject to our own security and credit card verification procedures. Janey McGill Photography reserves the right to withhold any Order that has failed to be verified. Should there be any problem with verification of your card details you will be notified via email.

4. AVAILABILITY

5.1 We endeavour to keep Janey McGill Photography as up to date as possible but cannot guarantee that a particular Product will always be available. If we are unable to supply a Product you will be refunded for it or offered an alternative.

5.2 All offers are available while stocks last. If we are unable to supply a Product you have Ordered, we will notify you via email, where possible, and will either refund you for that item or provide you with further information regarding future availability.

5. DELIVERY

5.1 Delivery of the goods. We shall send you an email to confirm the goods have been dispatched and shall aim to dispatch the goods as follows:

5.1.1 prints dispatched to your nominated address within 72 hours of your order being accepted by us; or

The above time frames are targets only.

5.2 Delivery costs. The costs of delivery to you will be as displayed on our website.

5.3 We are not responsible for delays outside our control. If our supply of the goods is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may

contact us to cancel your order and receive a refund for any goods you have paid for but not received.

5.4 If you are not at home when the product is delivered. If no one is available at your address to take delivery and the goods cannot be posted through your letterbox, the delivery company will inform you of how you may receive your goods. You should refer to the terms and conditions of the delivery company for more information.

5.5 If you do not re-arrange delivery. If you do not collect the goods from us as arranged or if, after a failed delivery to you, you do not re-arrange delivery or collect them from a delivery depot we will contact you for further instructions and may charge you for storage costs and any further delivery costs. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection we may end the Contract and you will receive a refund for any goods you have paid for but not received, less any delivery charges and other administrative charged involved in delivering, handling and storing your goods.

5.6 International delivery.

5.6.1 We deliver to the countries listed on our website (International Delivery Destinations). However, there are restrictions on some goods for certain International Delivery Destinations, so please review the information on that page carefully before ordering goods.

5.6.2 If you order goods from our site for delivery to one of the International Delivery Destinations, your order may be subject to import duties and taxes which are applied when the delivery reaches that destination. Please note that we have no control over these charges and we cannot predict their amount.

5.6.3 You will be responsible for payment of any such import duties and taxes. Please contact your local customs office for further information before placing your order.

5.6.4 You must comply with all applicable laws and regulations of the country for which the goods are destined. We will not be liable or responsible if you break any such law.

6 COPYRIGHT AND TRADE MARKS

6.1 All content of this site, including text, images, source codes, logos, icons and photos and all other material, is the property of Janey McGill Photography or its content providers and is protected by the United Kingdom and international copyright laws.

6.2 The site is for personal use only and users may not exploit any part of the content in any way without the written permission of the copyright owner. All rights reserved.

6.3 Permission is granted to print and electronically copy portions of the Janey McGill Photography site for the sole purpose of placing an order with Janey McGill Photography or using this website as a shopping resource. Any other use of this website and its materials, including reproduction for purposes other than those noted above, modification, distribution, or republication without the prior written permission of Janey McGill Photography, is strictly prohibited.

7 PRIVACY AND DATA PROTECTION

7.1 Janey McGill Photography is committed to protecting your privacy and promises only to use information collected about you in accordance with the Data Protection Act 1998..

7.2 When you place an Order, we may ask you for certain iJaney McGill Photography (for example your name, phone number, postal address, email address, contact and bank/credit card details). We may also record which Products you are interested in and which Products you purchase as well as customer traffic patterns and site use. This information will be kept securely in accordance with our internal security policy and may be used to: a) process your Order b) provide you with an up to date, efficient and reliable service c) help to prevent fraud i.e. we check card details with our merchant card checking facility and reserve the right to refuse Orders on that basis d) open and run your membership e) provide a more tailor made shopping experience.

8 RETURNS

8.1 You have the right to cancel your order at any time up to 7 working days after the day following the delivery of the goods by Janey McGill Photography direct by email, or telephone. Your right to cancel is on the basis that we will be able to re-sell the goods to another customer as new. If you have any questions about the goods or need help on deciding whether or not to keep them, please contact Customer Services for more information.

8.2 We do accept goods back at Janey McGill Photography, however only in the following circumstances:
We accept goods back, for any reason, that have been unused.
We cannot accept goods back that have been used.
All goods must received back to Janey McGill Photographyin the original packaging and resalable condition, including all labelling and pricing.

8.3 If the products have already been posted to you (or on your behalf to any other person), you (or the other person) must return the products to us at the time of cancellation and we will credit your credit or debit card with the price of the products within 30 days beginning with the day on which notice of cancellation was given.

8.5 If you have received the wrong goods, we will make sure that you receive the correct goods at no extra cost, and will bear all costs for the return of the products. Janey McGill Photography recommends that returns are sent via a method of recorded delivery as we cannot be held responsible for undelivered items. Please note that Janey McGill Photography will not be liable for the cost of returning the item.

On receipt of the damaged items Janey McGill Photography will send out a replacement immediately.

9 RESPONSIBILITIES

9.1 Janey McGill Photography has endeavoured to make the descriptions (including all images) of the Products as accurate as possible but we cannot be held responsible for changes in Size, Content or Presentation of Products.

9.2 Janey McGill Photography will not be liable in any amount for failure to perform any obligation under this agreement if such failure is caused by the occurrence of any unforeseen event beyond its reasonable control including without limitation Internet outages, communication outages, fire, flood, war or act of God.

9.3 These Terms do not affect your Statutory Rights as a consumer.

9.4 Subject as aforesaid, to the maximum extent permitted by law, Janey McGill Photography excludes liability for loss or damage of any kind howsoever arising, including without limitation any direct, indirect or consequential loss whether or not such loss arises out of any problem you notify to Janey McGill Photography and Janey McGill Photography shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:
any incorrect or inaccurate information on Janey McGill Photography;
any interruptions to or delays in updating Clare Haggas Fine Art & DesignsJaney McGill Photography

Inllectual Property rights of any third party caused by their use of Janey McGill Photography or any Product purchased through;
any loss or damage resulting from your use of inability to use the Janey McGill Photography website or resulting from unauthorised access to, or alteration of your transmissions or data in circumstances which are beyond our control;
any loss of profit, wasted expenditure, corruption or destruction of data or any other loss which does not directly result from our error;
any amount or kind of loss or damage due to viruses or other malicious software that may infect a user’s computer equipment, software, data or other property caused by persons accessing, using or downloading Janey McGill Photography, or from transmissions via emails or attachments received fromJaney McGill Photography ;
all representations, warranties, conditions and other terms which but for this notice would have effect.

10 Liability
